Terms of Service

These Terms of Service ("Terms") govern your use of Workhunters (the "Service"), provided by 1001664848 Ontario Inc., carrying on business as Workhunters ("Workhunters," "we," "us," or "our"), a corporation incorporated in Ontario, Canada. By creating an account or using the Service, you agree to these Terms and to the Privacy Policy, which describes how your data is processed. If you do not agree, do not use the Service.

1. Description of Service

Workhunters is an automated job discovery and application platform. The Service discovers job postings, provides AI-powered recommendations and match scores, generates tailored resumes from your profile, operates a dedicated application email address for you, and submits job applications to third-party employers on your behalf using automated browser technology — including, if you enable Autopilot, without your review of each individual application. We act as your agent in this process — we do not employ you, guarantee employment, or guarantee the outcome of any application.

You understand that applying to jobs for you, operating your application inbox, and using your personal data in automated systems is not incidental to the Service — it is the Service, and providing it requires the data processing described in these Terms and the Privacy Policy.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts in your jurisdiction to use the Service. By using the Service, you represent that you meet these requirements.

3. Account Registration

You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use. We record the version of these Terms and the Privacy Policy you accepted and when you accepted them.

4. Your Workhunters Email Address

At signup we assign you a dedicated application email address on the workhunters.org domain. By using the Service, you authorize us to operate this mailbox on your behalf:

  • To receive and store all mail sent to that address, including mail from employers and job portals.
  • To read, scan, and classify that mail with automated systems (including AI models) in order to organize your inbox, detect application outcomes and update your application records, and extract verification codes and links needed to complete applications.
  • To send email as you from that address in connection with your applications, including replies you compose in the Service.

The address is provided for job-application use through the Service. It remains part of the Service and is deactivated when your account is deleted. Do not use it for unlawful purposes or for matters unrelated to your job search.

5. Automated Application Submission

By queuing an application through the Service (or enabling Autopilot), you:

  • Expressly authorize us to create accounts on third-party job portals (such as Workday, Greenhouse, Lever, and others) in your name, using your personal information.
  • Authorize us to generate and store credentials for those third-party accounts (encrypted at rest) and reuse them for future applications on the same platforms. You may request a copy or deletion of these credentials at any time.
  • Authorize us to complete and submit job applications, including uploading your resume (or a resume the Service generated and tailored from your profile) and answering application questions using the answers and profile information you have provided.
  • Direct us to transmit your profile, resume, and answers to the employer and its applicant tracking system — acting as your agent. Once transmitted, that information is held by the employer under its own terms and privacy practices.
  • Confirm that all information provided is accurate, truthful, and does not misrepresent your qualifications or eligibility for employment.
  • Acknowledge that we cannot guarantee successful submission, employer receipt, or any response from employers.

You are solely responsible for the content of your applications. Submitting false or misleading information to employers through the Service is a violation of these Terms and may be unlawful.

6. Autopilot

Autopilot is an optional feature, off by default, that you may enable to have the Service automatically select and queue applications to jobs matching your profile and preferences without your review of each individual application. By enabling Autopilot, you authorize every application it queues and submits as if you had queued it yourself, including the account creation, credential storage, and data transmission described in Section 5. Autopilot runs consume credits in the same way as manually queued applications. You can disable Autopilot at any time, review and cancel anything it has queued before processing, and it pauses automatically if too many of its applications fail. Autopilot selects jobs based solely on fit with your profile and preferences.

7. License to Your Data; Service Improvement

You retain ownership of the content you provide. To operate an automated platform on your behalf, you grant us a license to host, store, reproduce, process, transmit, and display your content and data as needed to provide the Service, and you agree that the content and data you provide and that the Service generates for you — including profile fields, resumes, application answers and outcomes, the content of your Workhunters mailbox, and your interactions with the Service — may be used to develop, train, and improve the Service and its machine-learning models, as described in the Privacy Policy. This service-improvement use is limited to what the Privacy Policy describes and never includes your voluntary self-identification answers (such as gender, race/ethnicity, veteran status, or disability status) or payment information. We may also create, use, share, and commercialize aggregated and de-identified data that does not identify you, subject to the commitments in the Privacy Policy.

The Service itself — including its software, automation systems, machine-learning models, and all content we provide other than your content — is owned by Workhunters or its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service for your own job search while these Terms are in effect; no other rights in the Service are granted.

8. Credits System

  • Each application costs 1 credit, deducted when our automation begins processing it. Queueing an application is free.
  • If an automated application attempt fails (marked "failed"), 1 credit is refunded.
  • Canceling a queued application before processing begins costs nothing — no credit has been spent at that point.
  • Credits may be granted from your subscription plan, purchased credit packs, or promotions (including contribution rewards and referral rewards under Section 9). Promotional credits may carry additional conditions or expiry stated when they are granted.
  • Credits have no cash value and are non-transferable. They expire upon account termination.
  • We reserve the right to adjust credit pricing and allocations with notice.

9. Referral Program

Workhunters may offer a referral program that rewards you with promotional credits for referring new users. Where offered, the following terms apply:

  • A referral qualifies only when the person you referred creates their account using your referral code and then completes their first paid Starter or Pro subscription purchase. Referral attribution happens only at account creation and cannot be added retroactively.
  • When the qualifying purchase completes, the referred user receives 100 promotional credits. You receive 100 promotional credits if you hold an active paid subscription at that time; if you do not, your reward is held for 60 days and granted if you subscribe within that window, and forfeited otherwise. The referred user's reward is not affected by your subscription status.
  • One reward per referred person, ever. Re-subscribing or additional purchases by the same referred user do not trigger further rewards.
  • Rewards may be reversed if the qualifying payment is refunded, disputed, or charged back within 30 days of the purchase.
  • We may withhold, block, or reverse rewards, and retire referral codes, at our sole discretion in cases of self-referral, fake or duplicate accounts, or other abuse of the program.
  • Referral rewards are promotional credits: they have no cash value, are non-transferable, and are not redeemable for money. We may modify or end the referral program at any time; credits already granted are kept.

10. Payments and Billing

Subscriptions and credit packs are purchased through Stripe (stripe.com), our third-party payment processor. By making a purchase, you agree to Stripe's terms of service and privacy policy. Workhunters does not store your full payment card details — all payment information is handled directly by Stripe.

  • All purchases are charged at the price displayed at checkout, inclusive of any applicable taxes.
  • All sales are final. Purchased credits are non-refundable except where required by applicable law. By completing a purchase, you acknowledge this no-refund policy.
  • Credits and subscription benefits are delivered to your account immediately upon purchase. Where applicable law provides a cancellation or "cooling-off" right for digital services, you expressly request and consent to immediate delivery and performance, and you acknowledge that once delivery has begun this ends any such cancellation right to the extent the law permits.
  • Credits lost due to an automation failure (marked "failed") are refunded as in-platform credits, not as cash.

11. Acceptable Use

You agree not to:

  • Use the Service to submit applications you did not authorize or are not eligible for.
  • Provide false personal information, fabricated credentials, or misleading qualifications.
  • Use your Workhunters email address for spam, unlawful activity, or purposes unrelated to your job search.
  • Attempt to reverse-engineer, scrape, or interfere with the Service.
  • Use the Service in violation of any applicable law.
  • Share your account with others or use the Service on behalf of third parties without authorization.

12. Third-Party Services

The Service interacts with third-party job portals and employer systems. We are not affiliated with, endorsed by, or responsible for those services. Your use of third-party platforms through the Service is subject to their own terms of service and privacy policies. We are not liable for the actions, policies, or decisions of any employer or third-party platform.

Some job portals prohibit or restrict automated access or automated application submission. By using the Service you accept the risk that a portal may reject an application, or restrict or suspend an account created on your behalf, because it was submitted or operated by automation. Automation that the Service performs on your behalf is not a breach of these Terms by you.

13. Sponsored Listings

We may in the future display job listings for which employers have paid for placement or promotion. Any such listing will be clearly labeled as sponsored or promoted, and we will disclose any effect paid placement has on how listings or recommendations are ordered. Paid placement will not influence which jobs Autopilot selects for you unless you separately and explicitly consent to that.

14. Account Deletion and Hibernation

You may request deletion of your account in the app at any time. Your account then enters a 30-day pending-deletion period during which all processing on your behalf stops; signing back in during this window cancels the deletion. After 30 days, your account and personal data are permanently deleted as described in the Privacy Policy. You may alternatively hibernate your account, which pauses all activity while retaining your data so you can resume later. Unused credits are forfeited upon deletion. Account deletion and data export are always available to you, including if you decline updated terms.

15. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY APPLICATION WILL BE SUCCESSFULLY SUBMITTED OR RESULT IN EMPLOYMENT.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Workhunters SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF EMPLOYMENT OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM AND (B) CAD $50.

Some jurisdictions do not allow certain warranty disclaimers or limitations of liability. In those jurisdictions, the exclusions and limitations in these Terms apply only to the maximum extent permitted by law, and any rights you have under mandatory consumer-protection law that cannot be waived by contract are not affected.

17. Indemnification

You agree to indemnify and hold harmless Workhunters and its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or any false or misleading information you provided through the Service.

18. Termination

We may suspend or terminate your account for violation of these Terms or fraudulent activity, in which case unused credits are forfeited. We may also terminate your account for any other reason with reasonable notice; if we do, we will refund you for unused credits you purchased, pro rata to the price you paid for them (unused promotional credits and credits granted by a subscription plan are forfeited without refund). You may close your account at any time as described in Section 14.

19. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict of law principles. Disputes shall be resolved in the courts of Ontario, Canada.

20. Changes to These Terms

We may update these Terms from time to time and keep a dated record of each version. We will notify you of material changes via email or a notice in the Service before they take effect. If a change materially expands how we use your personal data, we will ask you to accept the updated Terms before the new use applies to your account. Otherwise, continued use after the effective date of changes constitutes acceptance of the updated Terms.

21. General

  • Changes to the Service: We may modify, add, or discontinue features of the Service at any time. If a change materially reduces what your purchased credits can be used for, the refund principle in Section 18 applies.
  • Severability: If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in full effect.
  • Entire agreement: These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service.
  • Assignment: You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets, with notice to you.
  • No waiver: Our not enforcing a provision is not a waiver of our right to enforce it later.
  • Force majeure: We are not liable for delay or failure to perform caused by events beyond our reasonable control.
  • Survival: Sections that by their nature should survive termination (including Sections 7 and 15 through 19) survive.
